Bonner
Bill Targets Employers of Illegal Aliens
Congressman
David Dreier (R-CA), Chairman of the House
Rules Committee, Congressman Silvestre
Reyes (D-TX) and T.J. Bonner, President of
the National Border Patrol Council
announced a renewed effort to pass the
Illegal Immigration Enforcement and Social
Security Protection Act of 2005. Referred
to as the Bonner Plan, H.R. 98 seeks to
enhance border security in two key areas.
The first is by updating identity
technology in the Social Security system.
The second is to provide additional
financial resources and manpower to the
Department of Homeland Security to enforce
compliance of I-9 employment eligibility
laws, the body of regulations addressing
the hiring of illegal aliens.
In
a press release, Congressman Dreier
stated, “The goal of this plan is to use
technology to enhance the most critical
document job seekers use, the social
security card, and make it much more
difficult to duplicate fraudulently. This
will make it clear to those coming here
for work that you can do so, but you must
do so legally.” He further added, “And
employers who knowingly hire illegal
immigrants must pay the price for breaking
the law. Significantly
increased penalties and sanctions will
discourage employers from continually
skirting the law of the land.”
Notable
requirements in the bill include the
employee’s obligation to

Obtain
an improved social security card and
§
Display
the card to the employer
The
employer’s obligations include
§
Verifying
that the new hire has the improved social
security card;
§
Verifying
that the new hire has work authorization
through a verification system.
The
new social security card would include a
machine-readable strip on the back along
with a photograph of the individual. In
addition, the new social security card
would include physical features that make
it difficult to counterfeit or tamper
with. The current social security card is
printed on banknote paper and can be
easily replicated.
Last
year’s passing of the I-9 electronic
signatures bill alleviates the daily
administrative burdens employers face.
However, the introduction of the Bonner
bill sends the clear message that
